- We were hired by an international hotel chain to
provide forensics services in a contract dispute. Our expert’s
testimony in federal court was instrumental in the judge’s decision
to grant our client’s motion for spoliation of electronic evidence.
Moreover, the defendant was ordered to pay all of our client’s
attorneys and experts fees incurred during the investigation and presentation
of the motion. We later provided trial testimony that the defendant’s
key electronic exhibits were not originals, but had been fabricated
in an attempt to deceive the court, and our client was ultimately awarded
almost $5 million in damages.
- A United States corporation suspected that key executives in its
Asia office were deleting files relevant to a pending litigation. Just four
hours after engaging First Advantage, our experts were on an airplane to the client
site in China. There, they worked for 18 hours straight, imaging laptops and
creating clone drives so that the company could continue normal business operations.
The original drives were shipped back to First Advantage for forensic examination,
and a large number of deleted emails were ultimately recovered.
- After our client brought a lawsuit against certain corporate partners
for fraud, First Advantage prepared an affidavit showing that it was likely that
relevant information resided in free space on the opposition’s hard drives.
Using this affidavit, our client obtained a court order to mirror image the
defendants’ hard drives. Two days after the order was issued, we had
imaged fifty drives and captured the information sought by our client.
- We testified in federal court on behalf of a company seeking to
obtain a preliminary injunction to stop the destruction of data by
its opponent. After our expert presented his testimony in court, the
Judge granted our client broad injunctive relief and found that the
opponent had intentionally destroyed relevant documents. The judge
indicated that an adverse inference instruction would likely be given
to the jury as a sanction.
- In a large on-line credit card fraud investigation, a First Advantage
expert uncovered more than 100 fraudulent Internet
credit card purchase transactions and a distribution
network for the illegally purchased
goods.
