IRS Will Continue to Accept Individual Tax Returns “Silent” on ACA

Becoming the first agency to take action in response to President Trump's Executive Order directing federal agencies "minimize...the economic and regulatory burdens of the Act", the IRS has told tax preparers that it will not automatically reject individual returns that do not state whether or not the filer had health coverage. Although at first blush accepting these such "silent" returns would appear to be a loosening of the enforcement of the ACA's individual mandate, this is not actually a change in policy as the agency accepted and processed over 4 million silent returns last year.

ACA Changes Continue to Be Delayed

In a Fox News interview aired Sunday, President Trump extended the timeline for his plan to replace the Affordable Care Act (ACA), saying that the "very complicated" process could take until "sometime into next year." This reference of a 2018 replacement timeline is far longer than that which has been indicated by the administration thus far. Previously the President had promised a replacement plan "almost simultaneously" with the confirmation of Tom Price as head of the Department of Health and Human Services.

Maine’s Marijuana Legalization Act and the Delay of Certain Portions of the Act

The tsunami of information available on medical and legalized/recreational marijuana notwithstanding, it is important to keep in mind that information in this area can and does shift rapidly. Having checked with the Maine Department of Labor's Team responsible for the Maine Substance Abuse Testing Programs, this writer can confirm that guidance on Maine's legalization law, the Marijuana Legalization Act Section 1. 7 MRSA c. 417 is not yet available on the Maine Department of Labor Website. This is because the legal aspects of employment are not settled. Although Maine's Marijuana Legalization Act went into effect on January 30, 2017, on January 27, 2017 H.P. 66-L.D. 88, An Act To Delay the Implementation of Certain Portions of the Marijuana Legalization Act  was approved by the Governor of Maine.
